In the Name of God Amen I John FitzPatrick of the county of Pittsylvania do make, constitute and ordain this my last Will and Testament in manner and form following Viz lmprimis it is my Will and desire that all my just debts and funeral Charges be first paid by my Execs hereafter mentioned Item I give and bequeath unto my Son John Fitz Patrick my tract of Land lying in Charlotte County on Cub Creek containing Four hundred and seventy five Acres more or less to him and his heirs forever- Item I give and bequeath unto my Son William F. Patrick my tract of Land lying in the County of Campbell on both sides of Molly's Creek containing Seven hundred Acres more or less, Also my Negro fellow named Pompey to him and his heirs forever- Item I give unto my Son David F. Patrick the Tract of Land whereon I now live containing Seven hundred Acres more or less, after the death of his Mother, also my Negro boys George and James, one feather Bed and furniture, one Desk and Book Case (the Negro boys he is to receive when he shall arrive at the age of Twenty one years. to him and his heirs forever- item it is my Will and desire that my tract of Land in Campbell County called Buzzard Mountain containing Two hundred and seventy six Acres more or less be sold by my Executors and the Money arrising from such Sale to be equally divided among all my Children, and I do hereby Impower my Executors hereafter mentioned to convey the same to the purchaser or purchasers- Item I leave unto my beloved Wife Behathaland F. Patrick the tract of Land whereon I now live together with all the Personal Estate thereon during her natural life Except such as 1 have WilI'd otherwise, and after her death to be equally divided among all my Children or their heirs forever- Lastly I constitute and appoint my Sons John and Edmund F. Patrick Executors of this my last Will and Testament Ratifi'ing and confirming this and no other to be my last Will and Testament In Witness whereof I have hereunto set my hand and Seal this 23 day of December 179 Five.- Signed, Sealed and Ackn'd by the Testator as his last Will and Testament in the presence of Nat Luck, Joseph Pemberton, Cornelius Mcflaney, John Pemberton

At a Court held for Pittsylvania County .loly 20 1801

The foregoing last Will and Testament of John Fitz Patrick deceased was presented in Court and proved by the

Oaths of three of the witnesses thereto and Ordered to be Recorded, and John Fitzpatrick, Edmund Fitzpatrick the

Executors therein named having first taken the oath by Law proscribed and together with David Pannill and

Cornelius McHaney their Securities entered into and acknowledged their Bond in the penalty of Ten thousand

dollars Conditioned as the Law directs on their Motion Certificate is granted them for obtaining a probate of the said

Pittsylvania Co., VA Deeds and Wills No. 11 1780-1820 pg. 306

Written: 28 MAY 1806

Probated: 20 JUL 1807

 

In the Name of God Amen, I David F. Patrick on the County of Pittsylvania and State of Virginia being of sound mind and memory do make and ordain this my last will and testament. Imprimis I recommend my soul to God who gave it and my body to the earth to be interred at the Discretion of any executors.  Item It is my wish that my Executors hereafter named --- Collect all moneys [?] due  me and pay all my Debts as speedily as possible and the balance of money then remaining to remain in their hands on Interest due Thursdays? applied  Item It is my wish and I do hereby require and authorize my Executors or Executrix if only one acts to sell and convey my land on Whipping Creek which I purchased of Thomas Black in Campbell County if he or they judge it for the interest of my Estate and not otherwise and I do also require and authorize them or him in like manner to purchase the tract of land whereon Sarah Luck now lives in Pittsylvania County when sold under the will? of Francis Luck Deceased of said county to be paid for out of any moneys in his or their hands and should my part of said land under any mortgage he or they are requested and authorized to purchase it in like manner for the use and benefit of my Estate as he or they may judge best   Item It is my wish that no division of my Estate in any way be made in less than five years after my Death unless any acting Executor or Executors judge it proper and best and in that Case the Estate is to be Divided Sooner.  Item   I wish my Estate to be Divided between my loving wife Sarah and my Children as the law Directs.  Item   It is my wish that my Executor or executors as the Case may be be the Guardians of my children and to have the entire? management of their Estate and educations and that my Children be raised and educated as well and genteelly as the income of their Estates will well? afford, that my male child or Children be lead to that business which shall appear most Suitable to their Genius I also wish my Children to remain with their mother until ten years old at least unless my Executors or Executor judge it best to act otherwise sooner.  Lastly I appoint my friends Samuel Pannill and Jeremiah Pannill my Executors to this my will who are to act on my Estate without Giving Security for thousand but are to Give bond in Court as other Executors in witness whereof I have here unto set my hand and seal this 28th day of May 18 hundred and six---- Signed sealed acknowledged in presence of Clark Stone, Nath Craddock, Booker Shelton?                 David F.   3. Sarah B. M Smith(Fitz Patrick)

 

                        Pittsylvania  County Will Book #2 page 145

                                Written: June 15, 1844

                                Probate: August 16, 1852

 

 

     In the name of God Amen.  I  S. B. M. Smith of Pittylvania County and state of Virginia, do make this my last will and testament in manner and form following, that is  to say after my death I desire that all my estate of  every description be sold on the usual credit and all of the moneys therefrom I desire of grandson John Ann Fitzpatrick be then living that he have twenty dollars in cash given to him out of my estate and should he die before I do in that case I desire that my estate be equally divided  between my two children Fanny Miller and John Fitzpatrick and that the part or portion of my estate falling to my daughter Fanny Miller be placed in the hands of my grandson William A Miller as Trustee for the benefit of his mother Fanny Miller to be paid over to her or applied to her use and benefit in the way and manner she may desire.  I appoint my son John Fitzpatrick my Executor and desire that no security be required of him for his performance, signed by me this 15th day of June 1844.

At a county court held for the County of Pittsylvania on the 16th day of August 1852.  This last will and testament of Sarah B. M. Smith dec'd was presented in court proved by Samuel Nowlin and James H. Davis two subscribing witnesses an ordered to be recorded.  And on the motion of John F. Patrick the Executor in said will named who made oath and entered into and acknowledged a bond in the penalty of two thousand dollars conditioned according to law certificate was granted him for obtaining probate of said will in due form. The executrix by her will not requiring security of the said executor.

In the name of God, Amen; I, John F. Patrick being of sound mind, make this my last will and testament.

 

I give to my son David W. F. Patrick my tract of land I now live on except the land east of the Buffalow road, which is 35 acres which 35 acres is to be sold to help to pay my debts, and all the personal property to be sold to pay my debts also.

 

I give to my daughter Mary Elizabeth, the Patrick's tract of land containing 280 acres and the Dillard land containing 390 acres and the tract of land bought of John Hobson on Dan River containing 450 acres, I give to my daughter Sarah Ann children equally the lands bought of Fay West & Drew (called the Fay Plantation) containing 256 ½ acres.

 

I appoint John F. Hobson my Executor to act without giving security Writen, Sind & seald with my own hand this 1st day August 1873.

At a County Court held for the County of Pittsylvania, on the 17th day of May 1880, a writing purporting to be the last will and testament of John F. Patrick deceased, was produced in the court by John F. Hobson the Executor therein named and there being no subscribing witnesses thereto, William Miller, L. Scruggs and R. W. Peatnoss (?) were sworn and (?)

  5. Edmund Fitz Patrick

 

Edmund Fitz Patrick's Will                                                                                       

Written: 9 April 1833   

Probated: 5 August 1833

 

In the name of God Amen.  I Edmund Fitz Patrick of the County of Charlotte being of disposing mind do make and ordain this my last Will and testament hereby revoking all others heretofore made.  In the first place I direct the payment of all my just debts and funeral expenses                                                                    

Item.  I lend to my beloved wife during her natural life the tract of land whereon I now live also her choice of four horses out of my stock, also two yoke of oxen and one Cart, her choice also one third of the Negroes her choice according to value, one third of the stock of cattle, hogs and sheep, plantation tools, to my wife I give all the Beds and furniture to be disposed of as she pleases finally to our four Children, Edmund, David, Behethehaland and Mary.  I also lend my wife one third part of all the rest of the house hold and kitchen furniture during her natural life.

To my Children, Patsy Harris, Thomas Patrick, John Patrick, Peter Patrick and Mildred Patrick I have heretofore given all that I intend for them. To my son Edmund I have advanced in money as much as I intend for him as relates to any (and) toward getting a tract of land-

After the death of my wife I give the tract of land on which I live and loan'd her for life to my three children David, Behethehaland and Mary in equal division to them and their heirs forever.

To my two daughters Behethehaland and Mary I give each the sum of one hundred dollars to be (cused) out of my estate to make up for not giving them a horse, which has been given to all my other children to them and their heirs forever- 

All the rest and residue of my estate whether real or personal I give in equal division to my Children Edmund, David, Behethehaland and Mary to them and their heirs forever--

All the estate loan'd my wife except the land except her death I give in equal division to my four Children Edmund, David, Behethehaland and Mary to them and their heirs forever-

            In case of the death of either of my four Children Edmund, David, Behethehaland and Mary   before they come lawfully to the possession of any legacy under my will or before marriage the I direct the estate herein given them divided amongst the Survivours-

            Lastly I appoint my friend Robert Morton and my sons Peter and John executers To

 this my last Will and testament.  As Witness my hand and seal this nineth day of April in the year of our Lord one thousand eight hundred and thirty three

      At a Court held for Charlotte County the 5th day of August 1833                                  This last Will and testament of Edmund F Patrick dec'd was produced in court and the same was proved by the oaths of George Hannah, William Reames and Cornelius Crews three of the subscribing witness thereto and ordered to be recorded- And on the motion of John E F Patrick one of the executer named in the said Will who made oath thereto according to law certificate is granted him for obtaining a probate of the said Will in due form he giving security. Whereupon   with William Harris and Peter F Patrick his executors entered into and  acknowledged bond in the penalty of fifteen thousand dollars conditioned, as the  law requires, reserving liberty to the other executors to join in the probate when  they shall think of it.
